The New Neighborhood (NN) subdivision is unusual because it is managed by four property owners associations (POAs) who co-manage the same common areas instead of just one. Each POA is associated with one of four completed phases of neighborhood development by the developer, Quercus Alba LLC. Each POA has a board of five elected directors, with four officers, who must be members of their respective POAs. All neighborhood lot owners are automatic members of their respective POAs. The four POAs are responsible for jointly managing the neighborhood common areas with neighborhood lot owners who are all co-owners of all the common areas — each lot of n total lots is associated with 1/n ownership of each common area. POA byaws currently require each board to hold an annual member meeting in March to determine annual POA budgets and the common area workplan for common area landscaping and septic system management. POA boards are required to show their POA assessment calculations — which may be significantly different for each POA — based on their POA budgets. These POA fees must be calculated and approved by members at least every three years. Though NN POA presidents and boards are legally required to comply with their POA bylaws and with the NN Planned Urban Development Agreement (PUD), many are not complying, and complaints are escalating.
